“The Chief Justice has exercised discretionary powers in appointment to the said posts for the SDAs from the quotas provided to promote group ‘D’ employees,” observed a division bench comprising Justice V G Sabhahit and Justice A S Bopanna, while dismissing the petition.
Ramesh, a resident of Nandini Layout, whose candidature was rejected, had challenged the appointments alleging that some persons, though not qualified, have been appointed for the posts.
The bench said that powers have been exercised including that to relax educational qualifications when qualified persons are not available, in the interest of the High Court.
