Jayalalitha, amongst other charges, is accused of possessing assets disproportionate to her known sources of income. The special court in Tamil Nadu took the cognisance of the offence and issued summons on June 5, 1997.
Terming the entire proceedings as violative of fundamental rights and provisions of CrPC, the petition contends that the impugned order did not refer to the contents of the charge sheet. “The failure to take cognisance as contemplated under law is an abuse of the process of law and foisted out of political vengeance. The order taking cognisance and the consequent trial are invalid,” the petition says. Jayalalitha has sought directions to the special court to call for the records, quash the order and the consequent trail proceedings.
