Lalit Modi gets interim relief from court

Providing interim relief to former IPL Commissioner Lalit Modi, Rajasthan High Court rejected the no-confidence motion  proposed by BJP leader Amin Pathan to oust Modi from president’s post of the Rajasthan Cricket Association (RCA).

During the hearing, the court pointed out several technical issues in the no-confidence motion proposed by rebel group in October 2014.

The court said that the rebel group, led by BJP leader Amin Pathan, is free to bring another no-confidence motion by March 13.   Earlier, Pathan and his group captured RCA office in a coup and claimed the support of 23 out of 33 district associations against Modi.

Pathan was announced as the new RCA president. Later the Modi faction moved the Rajasthan High Court against BJP leader Amin Pathan and his supporters. Writ petition was also filed against State of Rajasthan, The Commissioner of Police and SHO Jyoti Nagar police station claiming that a mob of around 100 persons, led by respondents, forcibly entered the RCA office but no action was taken.

Modi faction said that no appointments to the post of president, secretary and treasurer can be made in the absence of valid election in the presence of observer as per the Rajasthan Sports Act, 2005.

In court, Modi group stated that general meeting called by Pathan was illegal and it appears that false and fabricated documents were signed by unauthorised and fictitious persons to show them as representatives of the District Cricket Association.
