HC notice to state, KSPCB on plea against noise pollution

The High Court of Karnataka (vacation bench) on Thursday ordered notice to the state government and the Karnataka State Pollution Control Board (KSPCB) in a petition filed by residents of NGEF Layout.

The petitioners, Seenappa Gowda and others have contended that RMZ industrial complex, a commercial establishment located adjacent to their residential layout in Sadanandanagar in NGEF Layout is creating noise pollution in the area.
 
The petitioners have said that RMZ commercial establishment runs day and night and is fitted with air coolers and chillers which emit noise exceeding 70-80 decibels in the night and 90-100 decibels in the early hours of the day.
 
The petitioners have further contended that due to the noise pollution, the residents are suffering from serious health ailments and have sought directions to the KSPCB to take action under the Air (Prevention and Control of Pollution) Act, 1981, Noise Pollution ( Regulation and Control), Rules 2000. 

The petitioners have sought directions to shift the commercial establishment to an industrial area. 

A division bench comprising Justices Anand Byrareddy and Ravi Malimath ordered notice and adjourned the hearing.
