Advance bail for farmer: SC notice to state

The Supreme Court on Monday issued notice to Karnataka government on a plea for anticipatory bail made by a farmer from Raichur for removing 5,000 bags of paddy, given in pledge to IDBI Bank against loan of Rs 50 lakh to a co-accused.

A bench of Justices L Nageswara Rao and Mohan M Shantanagoudar sought response from the state government on a special leave petition filed by Siddalingappa.

The petitioner, a resident of Sindhanur taluk in Raichur district, approached the top court against the High Court of Karnataka's order of March 22, dismissing his plea for anticipatory bail.

Senior advocate Basava Prabhu Patil, representing Siddalingappa, challenged the order of Kalaburgi bench of the high court.

The high court has directed for immediate surrender of the petitioner before the police in the case relating to the offence of cheating, forgery and criminal breach of trust among others.

It has noted the charges against the petitioner and co-accused Suresh included that they clandestinely removed 5,000 bags of paddy from IDBI Bank, Sindhanoor branch. The paddy bags were deposited against Rs 50 lakh granted to Suresh. The high court has upheld the sessions court order rejecting anticipatory bail plea.
