'No police officer can pollute stream of justice,' SC objects to SHO arresting man, despite protection

New Delhi: The Supreme Court has said under the guise of police uniform, no one can be allowed to pollute stream of justice as it took exception to use of abusive language by a Station House Officer and arrest of a man by him, even after the protection granted by the apex court.

"Main kisi Supreme Court ka aadesh nahin manunga, mai tumhara sara High Court aur Supreme Court nikal dunga aaj" (I will not obey any order by the Supreme Court, today I will remove your misconceptions about High Court and Supreme Court), SHO, Gulaab Singh Sonkar alleged to have told the man, Ram Sagar Tiwari.

Taking up a contempt petition filed by Tiwari, the bench said the SHO's conduct clearly indicated prima facie there wass willful disobedience of the order of the court, which requires to be dealt with iron hands. The court noted this after going through a report filed by Additional Director General of Police, Prayagraj Zone, Prayagraj.

UP's Additional Advocate General, however, submitted, in the teeth of the said inquiry report, the state government would act immediately and apprise this court of the action taken by next date of hearing. 

The court scheduled the matter for hearing on November 7, 2025.

The contempt petitioner was granted protected by the apex court on March 28, 2025, with a specific direction that no coercive measures or steps should be taken against him in an FIR lodged under Sections 419, 420, 467, 468, 471 IPC, Police Station Kandhai, Pratapgarh.

However, it was alleged the SHO, Sonkar, Incharge Police Station-Kandhai, the arresting officer, Sub-Inspector Mithilesh Chaurasia,

and Sub-Inspector Rajesh Kumar, the second investigating officer, allegedly dragged the petitioner, arrested him and subjected him to sexual assault.
