Supreme Court says it will pass orders to dismiss PIL for contempt action against BJP MP Nishikant Dubey

The BJP lawmaker sparked a row when he said, '(the) Supreme Court is taking the country towards anarchy' and that 'Chief Justice of India Sanjiv Khanna is responsible for the civil wars taking place in the country'.

New Delhi: The Supreme Court on Monday declined to entertain a PIL seeking contempt action against BJP MP Nishikant Dubey for his alleged derogatory remarks against the top court and the Chief Justice of India.

The top court, however, clarified that it will pass a short order with reasons.

Dubey sparked a row when he said, “(the) Supreme Court is taking the country towards anarchy and that the Chief Justice of India (CJI) Sanjiv Khanna is responsible for the civil wars taking place in the country”.

Taking up a PIL by advocate Vishal Tiwari, a bench of Chief Justice of India Sanjiv Khanna and Justice Sanjay Kumar said, "We will be passing a short order. We will give some reasons. We will not be entertaining it, but we will give a short order."

Tiwari sought contempt action against Dubey for his alleged remarks, in an interview with a news agency, claiming those were derogatory towards the judiciary and the Supreme Court.

“The dignity of the institution has to be protected. It cannot go on like this," Tiwari told the bench.

Tiwari further alleged in his plea that political parties and leaders were not sparing the judiciary and judges over hate speech and provocative remarks.

The parliamentarian launched a broadside against the Supreme Court on April 19, saying Parliament and state assemblies should be shut if the apex court has to make laws.

The BJP MP's remarks came following the Centre's assurance to the court that it would not be implementing some of the contentious provisions of the Waqf (Amendment) Act till the next day of hearing after the court raised questions over them.

The BJP, however, had on April 19 distanced itself from Dubey's criticism of the Supreme Court, with party president J P Nadda calling the comments his personal views.
