Addressing a press conference on Wednesday, Nagaraj said BBMP Chief Engineer of West Zone B T Ramesh had recommended in his report for the withdrawal of the occupancy certificate following gross violations in the existing structure.

He alleged that the builder should have left at least 10 per cent of the total land for gardens as per the terms and conditions. Besides, a 16-metre space should have been left in front of the building as per the sanctioned plan, but it has left merely 8-metres space.
The logic given for not leaving the space was that the builder has agreed to build a 60-ft wide road on the other side of the building, Nagaraj said.

Traffic problems

He said the owners of Sampige Talkies gave a portion of their property for road widening, but the Mall builder did not leave an inch of space, due to which commuters are facing hardship, particularly on weekends and holidays.

Based on the alleged violations by Mantri Mall, the BBMP had levied a fine of Rs 34.82 crore on the builder.

“While the builder is yet to pay the penalty, the BBMP gave him occupancy certificate,” Nagaraj said.

He demanded the Government to hand over the cases of violations to the Lokayukta by all the builders in the City.

“If the Government fails to act on his complaint, I will lodge a complaint with the Lokayukta. Besides it, I will stage a protest with Congress corporators, workers and the local residents of Malleswaram near the Mall,” said the BBMP Opposition leader said.
