<p>Sandeep Patil, Counsel for Sohan Kumar who appeared before XXIII Additional City Civil and Sessions Judge, Chandrashekar B Hipparagi sought to stay the further proceedings in a private complaint lodged by two City-based advocates K N Balaraj and Sirajin Basha who obtained sanction from the Governor to prosecute Chief Minister B S Yedyurappa.<br /><br />Stay sought<br /><br />In his application, Sohan Kumar stated that he is seeking to stay the proceedings under Section 210 of CrPC as similar allegations in a complaint related to denotification scam made by Y S V Datta is being investigated by the Lokayukta.<br /><br />The matter is being probed already, he said. The magistrate shall stay further proceedings following the complaints, he added.<br /><br />In the second application submitted before the Court, the counsel requested the court to summon H D Kumaraswamy under Section 319 of CrPC as he is a co-accused in the same case.<br /><br />The application said that as the material before the court would reveal, the denotification was done by Kumaraswamy when he was a chief minister, at Rachenahalli village coming under Arkavathi village.<br /><br />Judge Chandrashekar B Hippargi,posted the matter to January 31. C H Hanumantharaya, counsel for complainants objected to the applications stating that the accused has no locus standi.<br /></p>
