Two advocates K N Praveen Kumar and Dharmapal had filed the petition challenging the candidature of C P Yogeshwar, M Narayan Swamy and S V Ramachandra, calling it unconstitutional and illegal.
A division bench headed by Chief Justice J S Khehar observed during arguments that the candidates were allowed to resign and join another party and subsequently contest from that party.
It further observed that the act was not opposed to the spirit of the provision enumerated in the 10th Schedule. Following this, the petitioners chose to withdraw the petition and the matter was dismissed.
