Bidari files petition seeking quashing of CAT order

According to the petition filed by Bidari, the CAT order excludes him and five others from the list of officers for promotion to the DGP post.

The post of the DG and IGP fell vacant on January 31, 2011. The government was supposed to send a list of nine most eligible and qualified senior police officers to the Union Public Service Commission (UPSC) for selection.

The CAT on April 21 directed the State government to forward the names of only those officers in the rank of Director General of Police (DGP) and ensure that it reached UPSC on May 1.  The State was also directed to make an appointment on or before June 1.
The Commissioner has contended that the CAT granted the prayers not sought by the applicant, D V Guruprasad, at present the ADGP of Recruitment and Training.

‘Violation of Constitution’

The petitioner has further contended that he is qualified for the post on the basis of his 30 years of service and an unblemished record and not considering his name for the appointment amounts to violation of Articles 14 and 16(1) of the Constitution.

Bidari has sought for directions to quash the CAT order and dismiss the application filed by Guruprasad along with an interim prayer to stay the CAT order. The matter will be heard on Thursday.
