A vacation Bench of Justices G S Singhvi and C K Prasad granted bail to Guha, taking a view that possessing materials supporting armed rebellion or revolution against the state does not constitute an offence.
The Bench directed Guha’s release on furnishing a personal bond of Rs 2 lakh and two sureties of Rs 1 lakh each.
Guha was convicted along with Binayak Sen and Naxal ideologue Narayan Sanyal and awarded life term in December last year for allegedly colluding with Maoists to establish a network to fight the Chhattisgarh state. The apex court granted Sen bail on April 15.
