SC rejects Kani bail plea

A Special Bench of Justices G S Singhvi and B S Chauhan which heard her bail plea observed that the 43-year-old daughter of former Tamil Nadu chief minister and DMK chief M Karunanidhi could invoke provisions of the Criminal Procedure Code allowing special treatment to women, aged and others before the trial Court.

"In her application, petitioner no.2 (Kanimozhi) shall be entitled to again invoke the provisions of Section 437 of the Code of Criminal Procedure. The fresh applications filed by the petitioners shall be decided by the Special Court without being influenced by the rejection of the earlier applications,” the Court’s order said.

The Court, which also rejected a plea made by Kalaignar TV MD Sharad Kumar for bail, took exception to counsel for the accused contending that they were not hungry for money.

“Hungry people neither take bribe nor do they come to the courts. None of them is a hungry person,” the Court said to the argument of senior advocate Altaf Ahmed that the accused were not hungry for money and a sum of over Rs 200 crore was given to Kalaignar TV as loan.

The CBI is likely to file another charge sheet in the high-profile case at the end of this month after which the Court would frame charges based on the prima facie evidence produced by the probe agency. DMK sources said its chief Karunanidhi would land in the national capital Tuesday to visit his daughter.
