A S Premanath had moved the Court challenging the single judge order setting aside his appointment. He had contended that he was not given an opportunity to file objections.

Respondent Ramalingegowda in his submission had said that the KMF Board had made certain amendments to the bylaws against him.

He submitted that according to the rules, the National Dairy Development Board and the Union Government should give concurrence for removal of the managing director from his post. Ramalingegowda was suspended following the allegations of misappropriation. He was replaced by Premanath.

The Division Bench comprising acting Chief Justice Vikramajit Sen and Justice A S Bopanna, set aside the single judge order with a direction to conduct fresh hearing.
The Bench has also directed not to act on the amended bylaws until the disposal of the matter.

Elephant deaths

The Division Bench adjourned the hearing of suo motu petition on elephant death, after the Forest Department sought time to make a power-point presentation before the court.

During the hearing, Government counsel R G Kolle submitted that the conflict cannot be mitigated completely, but can be reduced to a certain extent.

He sighted successful measures taken by the department in various places. The Division Bench directed to arrange for presentation in the second week of November.
