SC directs Nupur Talwar to surrender before court

The Supreme Court on Friday directed Nupur Talwar to surrender before the trial court which had issued non-bailable warrant (NBW) against her after rejection of the CBI closure report in her daughter Aarushi and domestic help Hemraj murder case of 2008.

A bench of Justices A K Patnaik and J S Khehar declined to grant any relief to Talwar, who along with her husband Rajesh Talwar, are now facing heat in the twin murders.

The court directed her to appear before the Ghaziabad’s trial court on Monday.

“We are not inclined to stay the operation of the order of NBW. We direct that the petitioner (Nupur ) will appear on Monday before special magistrate and mover her bail. In case, an application of bail is moved, the same shall be considered expeditiously,” the bench said.

Senior advocate Mukul Rohtagi, appearing for her, pleaded for grant of protection before she is asked to surrender as the special magistrate may not be able to grant her bail as the case was triable in a sessions court and she may be arrested.
The court, however, was not convinced.

“You go to the court of special magistrate and apply for bail and if you don’t get bail, higher forums are there,” the bench said.

“The writings on the wall are clear,”  counsel intervened in an attempt to get some protection or relief.

The bench again said, “Till now, magistrate’s order stands, we have not altered it.”
Counsel said, “I am a law-abiding citizen.” To this court reminded him that Talwar’s husband had already got the bail in the matter.

The special CBI magistrate had issued NBW against Talwar after she failed to appear before it.
