No SC relief to Tiwari

The Supreme Court on Thursday refused to grant any relief to Congress leader N D Tiwari, who had challenged the order to give his blood sample for a paternity test sought by a man claiming to be his son.

“We are not inclined to interfere in the order of division bench of the Delhi High Court,” a bench of Justices Deepak Verma and S J Mukhopadhaya said.

The High Court had on April 27 ordered the 86-year-old politician and former governor to undergo the DNA test. It had directed that police force can be used to compel him to give the sample.

At the outset of the hearing, the bench said that the politician should cooperate in giving blood sample.

Senior Advocate Gopal Subramanium, appearing for Tiwari, contended that he was too old to give the blood sample, but failed to impress the court. “It does not mean that blood is not running in his body. Can the order of the court be flouted because of stature of the person? We are not with with you. It is very clear. You will have to go and give blood sample,” the bench said.

The SC directed that confidentiality would be maintained while sending the blood sample to a laboratory in Hyderabad.
