HC rejects contempt plea against Modi

The Gujarat High Court on Friday rejected a contempt plea against Chief Minister Narendra Modi for not giving prosecution sanction permission against a minister.

The Modi government recently refused to give prosecution sanction against Minister of State for Fisheries Purshottam Solanki for his alleged role in a Rs 400-crore scam.

The court, however, ordered that the final say on the sanction will be taken by the governor.

A contempt petition was filed against the chief minister and his cabinet colleagues by advocate Mukul Sinha who alleged that they refused a prosecution sanction without the consent of the state governor.

However, the state government in its reply on Friday stated that the cabinet decision of June 27 had been duly forwarded to the governor the next day.

Advocate general Kamal Trivedi informed the two-judge bench of Justice Jayant Patel and Justice C L Soni that the government had acted as per a court order and taken a decision on the sanction plea.
