Man gets five-year jail for trying to rape minor

A Delhi court has sentenced a man to five years in jail for attempting to rape a minor in 2010.

Additional sessions Judge Rajneesh Kumar Gupta also imposed a fine of Rs 1,000 upon Delhi resident Joginder alias Virender Sharma.

“The prosecution has proved its case beyond the reasonable doubt against accused (Joginder) that on February 21, 2010 accused had attempted to rape the girl,” the court said.

According to the prosecution, Joginder had tried to rape the eight-year-old near a dispensary in Shiv Vihar area here on the evening of February 21, 2010, when she had gone out to buy vegetables.

The prosecution told the court that Joginder, whom she used to call uncle, was standing in front of the shop and when she did not find the vegetables of her choice at the shop, Joginder took her to an another shop where she bought the vegetables.

But when she told him that she was going home, he caught hold of her and took her to a nearby dispensary, where he tried to rape, but was caught and beaten up by public as the girl had raised alarm, the prosecution said.

During the trial, Joginder’s counsel said his client was falsely implicated in the case as he had a quarrel with the girl’s uncle and contended that the girl’s testimony was not reliable as she was a tutored witness.

The court, however, convicted him saying the girl’s statement was corroborative and no material has been placed on record by Joginder to discredit her testimony.
