Forum orders housing society to pay interest

The Mysore District Consumer Disputes Redressal Forum has ordered the Jnanaganga House Building Cooperative Society Ltd  (JHBCSL) to pay 12 per cent interest on Rs 1.75 lakh initial deposit paid for a site.

     Partially allowing the complaint filed by P Krishna Kumar, the forum, in its recent order, said the JHBCSL should pay the interest on Rs one lakh from March 10, 2007 to March 16, 2011 and on Rs 75,000 from January 23, 2008 to March 16, 2011.

It also directed the JHBCSL to pay Rs 2,000 as costs to the complainant, who had alleged that there was delay in refunding of the advance money.

     Krishna Kumar had also named the president of the Coffee Board Employees Association in the complaint.

However, the forum held that there was no deficiency on his part and dismissed the complaint.

   The complainant said that he had become a member of the association by paying Rs 5,000 as share amount and applied for a 30x40 site.

He contended that the site was promised for Rs 2.5 lakh but later the amount was increased to Rs 3.75 lakh. Following this, he decided to seek refund of the initial deposit.  But the JHBCSL and the association had delayed the payment.
 He had moved the forum seeking 18 per cent interest on the initial deposit and Rs 1.5 lakh as costs.
