Hit by car 8 years back, man gets compensation

 A man, who was hit by a rashly-driven Honda City car and sustained grievous injuries eight years ago, has been awarded a compensation of over Rs 3 lakh by a Motor Accident Claims Tribunal.

MACT presiding officer Sanjiv Jain directed New India Assurance Company Limited, with which the offending vehicle was insured, to pay the compensation amount.

“I award Rs 3,56,100 as compensation. Insurance Company is directed to deposit the awarded amount in favour of the petitioner directly to the State Bank of India, Saket Courts Complex Branch within 30 days,” the tribunal said.

The order came on a petition by south Delhi resident Harak Singh Rawat who said a rashly-driven Honda City car had hit his two-wheeler in September 2004 near Qutub hotel here. Rawat told the tribunal that due to the impact of the accident, he sustained grievous injuries and was immediately rushed to a nearby hospital.

During adjudication of his plea, the doctor, who had treated Rawat, had deposed before the tribunal that he had sustained multiple injuries on his body and had also suffered a fracture in his neck.

Tek Chand Gupta, the owner of the offending car, contested the plea saying the accident was not caused by his vehicle and a DTC bus running behind Rawat had hit his scooter resulting in the injuries sustained by him.

The MACT rejected Gupta’s argument considering that the IO  had recorded the statement of a eyewitness who had stated that Rawat was hit by Gupta’s car and not by a DTC bus.
