Social activist seeks CM's sanction to prosecute 3 ministers

Social activist T J Abraham today sought Chief Minister Jagadish Shettar's sanction to prosecute three ministers, including Deputy Chief Minister R Ashok for alleged 'massive illegality and corruption.'

In a letter to him, he said he intended to file separate complaints in the Court of Special Judge (Lokayukta Court) for trial of offences under the Prevention of Corruption Act,1988 alleging massive illegality and corruption by Ashok, in charge of Home Affairs and Transport, Industries Minister Murugesh Nirani and Higher Education Minister Arvind Limbavali.

Quoting a High Court judgement in B V Acharya Vs Vekateshappa case, he said it had been held that a Special Judge under the PC Act, 1988 has no power to direct investigation under Sect 156(3) of Criminal Procedure Code, 1973 unless and until there is a valid sanction issued by the appropriate authority in terms of Section 19 of the PC Act, 1988.
