HC orders survey of 'nala'

The High Court of Karnataka on Tuesday ordered a survey of the ‘nala’ (storm water drain) in Mantri Tranquil apartment, off Kanakapura Road, by the City Survey Department with the help of Revenue Department.

The court was hearing the petition filed by Mantri Developers and the Mantri Tranquil Apartment Owners’ Association. The BBBMP has accused Mantri Developers of encroaching upon the storm water drain for its Mantri Tranquil project in Gubbalala village near Uttarahalli.

The BBMP, in its notice, had stated that the ‘C’ and ‘D’ blocks of the apartment were located exactly on the SWD, and ordered the builder to remove the encroachment. This had prompted the builder to move the HC.

On Tuesday, the government advocate contended that the SWD passes through the middle of the property, but the counsel for Mantri Developers refuted the claim, saying the SWD passes through the south of the property.

Justice Ram Mohan Reddy observed, “There is a dispute about where the ‘nala’ passes from. The BBMP says it passes through the middle of the property whereas the petitioner states it passes through the south of their property. Let a survey be conducted to ascertain the facts. The City Survey Department can do the job with the help of the Revenue Department, which has all the revenue records with it.”

Justice Reddy sought to know what the BBMP had done to find out the originating and end points of the SWD. The Palike counsel expressed his ignorance. The court then directed the BBMP to place before it all the relevant records on Friday.

CBI report on Dec 31
The CBI which is probing the March 2, 2011 incident of clashes involving advocates, police and the media, has made submission before the HC on Tuesday stating that it will submit its report on Dec 31, 2014.
