2G case: Court records statements of accused

A special CBI court on Thursday recorded statements of five more accused in the money laundering case relating to 2G spectrum scam, including a director of Kusegaon Fruits and Vegetables Private Limited, Asif Balwa.

Eversmile Construction Company Private Limited, Conwood Construction and Developers Private Limited, Dynamix Reality and Kusegaon Fruits and Vegetables Private Limited were others whose statements were recorded by the special Court
under Section 313 of the Criminal Procedure Code (CrPC).

These companies are facing trial along with former telecom Minister A Raja and fourteen other accused.

Under Section 313 of the CrPC, the court asked questions to the accused in the case. The accused could tell his or her side of the story while answering the Court’s questions.

In this case, the court has supplied 400 questions to each of the accused, seeking their reply. Balwa and the four accused companies submitted their replies to the court in pen drive.

Special CBI Judge O P Saini minutely examined the replies of each of the five accused and took them on record throughout the day. The accused signed the hard copies of their replies after Court took them on record with some corrections in the presence of both the prosecution and the defence.

“We have to complete the recording of statements of all the accused by tomorrow,” the Special CBI Judge said, directing the prosecution and the defence to be present at the court by 10.30 on Friday to record the statements of the remaining accused.

The court has so far recorded statements of six accused including Raja, Kanimozhi, DMK President M Karunanidhi’s wife Dayalu Ammal, Bollywood producer Karim Morani, Swan Telecom promoters Shahid Usman Balwa and Vinod Goenka, besides managing director of Kalaignar TV Sharad Kumar.

After finishing recording of the accused’s statements, the court would fix a date for final arguments.

The court began the trial in the case after framing charges against the accused in October 31 last year.

The accused have been charged of parking a bribe money of Rs 200 crore in Kalaignar TV in collusion with each other against the granting of telecom licences to DB Group companies by Raja.
