Notification on reservation struck down

Hearing a petition by C B Kuberappa and others, a division bench headed by Justice A V Srinivasa Reddy directed the Transport Department to rework on the reservation for direct recruitment and promotional vacancies of Regional Transport Officers (RTO). The bench said that the reservation should be 15 per cent and three percent respectively.

“The reservation to the posts of RTO has exceeded the permissible percentage and government shall take steps to review the promotions made to RTO and maintain reservation to the extent of prescribed percentage within one month,” the KAT directed.
The bench observed, “Few people have been promoted due to wrong interpretation of the decision of Supreme Court, but they can continue in the present posts till the review.”

Government rapped  

The tribunal lashed out at the government and the Transport Commissioner for failing to discharge their duties in the matter of maintaining the roster system in RTOs. “It was the duty of the government to maintain roster in each cadre. Government has failed to implement its earlier order issued in 1978.” the bench said.

The bench also directed the  government to constitute a committee consisting of experts within three months to inspect all the departments to verify whether the reservation is followed as per prescribed percentage.
