Notice to transport dept over 100 cc bike rule

The High Court of Karnataka issued notice to the transport commissioner and others on a petition regarding the ban of pillion seats on two-wheelers of less than 100 cc.

Justice B V Nagarathna was hearing a petition filed by TVS Motor Company Ltd and Hero Motor Corp Ltd challenging a circular issued by the state government for banning the registration of two-wheelers below 100 cc with pillion seats.

Section 143 (3) of the Karnataka Motor Vehicles Rules, 1989 says, "No pillion seat shall be attached to a motorcycle with engine capacity of under 100 cc."

The petitioners have asked for quashing the circular issued by the transport department or to declare that section 143 (3) of the Karnataka Motor Vehicles Rules does not apply to motor vehicles having capacity of under 100 cc.

The petitioners had moved the court stating that over 1,000 vehicles have been manufactured and over 50,000 customers will be affected by this rule.

The petitioners have also asked for an interim stay on the implementation of the act.

The matter was adjourned to Friday.
