No objection to Amin turning approver if he speaks truth: CBI

This was said in a reply filed by CBI counsel Ejaz Khan during hearing on Amin's application for becoming an approver and seeking pardon in the court of chief additional judicial magistrate A Y Dave.

"(Amin's) application be allowed on strict condition of his making full and true disclosure of the whole of the circumstances within his knowledge relative to the offense and to every other person concerned, whether as principal or abettor, in commission thereof," the CBI reply said.

Today, Amin, through his lawyer Jagdish Ramani, filed an application saying that he was ready to record statement under section 164 of the Criminal Procedure Code (CrPC) which is required to grant pardon to an accused.

Amin had last month filed an application in the court to become approver and had also asked the court to grant him pardon in the case. Eight accused in the fake encounter case including suspended IPS officers Vanzara, Dinesh M N and Rajkumar Pandiyan have objected to Amin's turning approver.

The court also asked the eight accused to file affidavits describing their objections by August 13.  Amin, who is at present lodged in Sabarmati jail along with other accused of the fake encounter case, was assistant commissioner of police (ACP) city crime branch before being arrested in 2007 based on statement of a witness involved in the operation of abducting Sohrabuddin and his wife Kausarbi.

His application came one day after CBI arrested former Gujarat minister of state for home Amit Shah in the fake encounter case.

Amin had also asked for transfer from Sabarmati jail as he feared for his life. However, the court had rejected his application for jail transfer and directed the jail authorities to provide adequate security to Amin and keep him separate from other accused in the case.
Meanwhile, the court has also called all the accused in the case to the court on August 13 to give them copy of the chargesheet.
