Withdrawal of consent to NICE set aside

The three judge Bench comprising Chairman Justice A M Farooq, and members B N Thyagaraja and Lawrence Surendra has set aside the order as well as the impleading applications by the land losers.

“Thus, after considering all the facts and circumstances of the case, we are of the view that the impugned order cannot be sustained and liable to be set aside”,  Bench observed.  

Then Chairman of Karnataka State Pollution Control Board, had withdrawn the Consent for Establishment on September 20, 2006. The appellants had submitted that the withdrawal was based on a newspaper report and no clear reasons was cited.
