<p>The three judge Bench comprising Chairman Justice A M Farooq, and members B N Thyagaraja and Lawrence Surendra has set aside the order as well as the impleading applications by the land losers. <br /><br />“Thus, after considering all the facts and circumstances of the case, we are of the view that the impugned order cannot be sustained and liable to be set aside”, Bench observed. <br /><br />Then Chairman of Karnataka State Pollution Control Board, had withdrawn the Consent for Establishment on September 20, 2006. The appellants had submitted that the withdrawal was based on a newspaper report and no clear reasons was cited. <br /></p>
