Last Updated 13 November 2010, 12:32 IST

"After the two-thirds members of both Lok Sabha and Rajya Sabha approve the impeachment motion against Justice Sen, then it will go to the president for approval," Moily told reporters after inaugurating a new building of the Agartala bench of the Gauhati High Court.

"A panel of judges headed by Supreme Court Justice B.Sudershan Reddy, held Justice Sen guilty in misappropriation of public funds," Moily added.A three-member committee formed by the Rajya Sabha to probe the allegations against Justice Sen held him guilty of corruption.

The panel, constituted by Rajya Sabha Chairman Hamid Ansari, was headed by Justice Reddy and comprised Punjab and Haryana High Court Chief Justice Mukul Mudgal and noted legal expert Fali Nariman. Its report was tabled in the upper house Wednesday.

An impeachment motion was moved against Sen in February 2009 after a notice signed by more than 50 Rajya Sabha MPs was submitted by Communist Party of India-Marxist leader Sitaram Yechury to Ansari, who then constituted the three-member probe panel.
