No transfer of case on designating senior advocates

The High Court has refused to transfer the petition challenging the process of designating senior advocates to any other judge and dismissed the memo filed by the petitioner.  

A division bench comprising Chief Justice D H Waghela and Justice Ashok B Hinchigeri adjourned the hearing to September 1.

The petitioner, M Veerabhadraiah, had contended that while designating senior advocates to the High Court, the appointing body (judges of the court) had not followed the rules and regulations. The petitioner had filed a memo seeking transfer of the case to another judge who had not participated in the designating process. However, the division bench refused to transfer the case and dismissed the petition. The bench observed that they were ready to hear the matter in th same bench. 

During the hearing, the petitioner’s counsel said that it would not be right for him to argue before the bench as the judges before him are also parties in the matter.
