The petitioners, co-operative milk unions of Mysore, Kolar, Tumkur, Shimoga, Mandya and Dakshina Kannada,  had moved the High Court challenging the Government proposal to nominate members to co-operative milk unions.

The petitioners said that the Government had nominated members to the unions at this juncture when the elections to the post of Chairman and Vice-Chairman for respective milk unions is scheduled in the middle of July. The proposal for nomination is bound to affect the elections.

The petitioner further argued that the government has no power to nominate the members to milk unions under Co-Operative Act. But the state is trying to increase the strength of the members by nomination, despite the fact that the nominated members have no right to vote in a co-operative society. Justice Ram Mohan Reddy, who heard the matter has stayed the further proceedings.
