National Judicial Commission sought

Speaking to reporters, Abdul Riyaz Khan, Chairman, KSBC said that the council had in 2003 requested the Government to constitute the NJC  and empower it to probe into the corruption charges involving judges.

“It will be a quasi judiciary body with Judges, representatives of bar council, senior advocates and representatives of Government. Constituted in consultation with Chief Justice, the commission will have a say in appointment of higher judiciary as well as to look into corruption charges,” Khan added.

He said that, in the present circumstances, to initiate action against Judges facing corruption charges in the higher judiciary, the parliament impeachment is necessary.  “It is a lengthy process, but once the NJC is formed, the question of impeachment does not arise. The commission will take care of it,” Khan said.

Transparency

Khan, advocating transparency in the judiciary, said that the as per their resolution dated August 29, 2008, the High Court judges and their family members should declare their assets.  On the inquiry into the allegations against Chief Justice P D Dinakaran, it should be transparent. Khan said that the Bar Council meeting to be held on October 2, 2009 will also discuss on all these aspects.
