'Married woman can't claim consent was taken on false promise to marry': Madhya Pradesh High Court

The aforesaid judgments of the Apex Court as well as this Court postulate that when the prosecutrix is married lady, and therefore, her consent for physical relationship on the garb of false promise of marriage cannot be brought within the framework of the consent obtained on the basis of ‘misconception of the fact', the court said.

Madhya Pradesh High Court on Saturday said that a married woman cannot claim consent was taken on false promise to marry, as reported by Bar and Bench.

Judge Maninder S Bhatti quashed last year's rape case that was filed by a married woman against a man.

The court said, "The aforesaid judgments of the Apex Court as well as this Court postulate that when the prosecutrix is married lady, and therefore, her consent for physical relationship on the garb of false promise of marriage cannot be brought within the framework of the consent obtained on the basis of ‘misconception of the fact'," as per the report.

The man who was booked in the case had moved to the high court after the woman filed a complaint accusing him of rape.
