 A Bench of Justices P Sathasivam and B S Chauhan, however, upheld the conviction of Nair. The court took into consideration the ill-health of 80-year-old Nair, who is afflicted with dementia and Alzheimer’s and failed to identify even his family members. The court passed its order on his review petition.

He was convicted on February 10 with former Kerala electricity minister Balakrishnan Pillai and another official by the apex court which had reversed the acquittal order passed by the Kerala HC on the appeal filed by Chief Minister V S Achuthanandan.

The court had earlier held that the former minister entered into a criminal conspiracy with others and dismissed the review petitions of Pillai and former official P K Sajeev.
