Supreme Court tells Sharad Yadav to vacate government bungalow by May 31

The Supreme Court on Thursday allowed disqualified Rajya Sabha MP and former Union Minister Sharad Yadav time till May 31, 2022 to vacate the official bungalow allotted to him in Delhi.

A bench of Justices D Y Chandrachud, Sanjiv Khanna and Surya Kant granted Yadav time on "humanitarian grounds" in view of his ill-health.

The court said the extension of time was given on condition that Yadav would file an undertaking that he will vacate the premises after May 31, 2022.

The bench also pointed out the top court has not gone into the issue of the validity of disqualification, which is pending before the Delhi High Court.

Earlier, on March 28, the court had asked the Centre to consider on humanitarian ground, the plea by Yadav against an order to vacate a government bungalow within 15 days as he was on a ventilator and had to undergo dialysis everyday.

Yadav had assailed the Delhi High Court's order of March 15 directing him to hand over the possession of the official accommodation, Bungalow no. 7, Tughlak Road, New Delhi, within 15 days.

The High Court had noted since the petitioner stands disqualified and is not being required to discharge any responsibility or function as a Member of Rajya Sabha, there can be no justification for him to retain the official accommodation.

He stood disqualified on December 1, 2017 under the Anti-Defection law for his repeated conduct, including statements against the JD(U) and its leadership.
