Last Updated 30 June 2009, 17:34 IST

The petitioners, Aloysius D’souza and 572 others, all employees of institutes under Catholic Board of Education, had moved court, after the government in the letter dated November 10, 2005 rejected the request to extend the benefit to the staff of private college.

Counsel for petitioner, Prasanna Deshpande submitted that as per the directions of the apex court, the government should not discriminate while determining salary or increment. Accordingly, the employees in government service as well as those who serve indirectly should be treated equally in terms of pay and other allowances. Justice Abdul Nazeer directed the government to extend the benefit to the staff of private aided colleges too saying “ You cannot discriminate between two employees as both are similarly placed by the government.”
