Post office directed to pay parcel value

Manjit Kaur Sodhi had booked a parcel to Jalandhar from the Jayanagar East Post Office, Bangalore. The parcel contained material worth Rs 14,727. The consignment did not reach the destination and after repeated enquiries, the Department offered her to pay Rs 240. She complained to the Forum where the post office claimed that it was not liable for the delay, loss or wrong delivery of parcels. The Forum did not agree with the contention and passed the orders.

Refund ordered

Anthony George had paid Rs 10,000 to the Holy Family Education Society for admitting his daughter for BSc Nursing course. He had submitted all the original testimonials. His attempts to ascertain the admission of his daughter went futile. With no other go, George admitted his daughter to another institution and approached the forum seeking refund of the money, which came to be allowed.

Dismissal upheld

The Karnataka State Consumers Disputes Redressal Forum has upheld dismissal of a complaint by a district forum  challenging repudiation of insurance claim by the Life Insurance Corporation of India in the absence of documents.

The appellant Gadiyappagouda’s son died in an accident involving his bike on Gadag-Koppal road. He had four policies on his life with the sum assured totalling to Rs 16.25 lakh. He contended that the LIC repudiated the claim on the ground that the insured was not in possession of a valid driving licence at the time of accident.

Gadiyappagouda at the first instance approached the district forum which dismissed the claim for want of documents. The State Commission also dismissed the appeal observing that the complainant ought to have procured a copy of the FIR and charge sheet.

“If the DF has not considered the pleadings and documentary evidence produced it could be said that it is wrong in not appreciating the evidence and the law laid down by the Apex court. In the absence of such evidence, we are of the firm opinion that the DF is right in dismissing the complaint,” the Commission noted.
