HC dismisses Katta Jagadish's petition

Last Updated 20 April 2011, 13:12 IST

Justice B S Patil dismissed the petition filed by Katta Jagadish, son of former minister Katta Subramanya Naidu, who is allegedly involved in the land scams.
The court had reserved its orders on the plea on April 15.

Counsel for Jagadish, C V Nagesh had raised objections on senior counsel B V Acharya representing the Lokayukta police. He said there was also no notification from the state government in this regard. Nagesh further submitted that since Lokayukta had already appointed a prosecutor to probe the land scam, appointment of Acharya as prosecutor on behalf of Lokayukta was "not correct".

Acharya argued that under section 24 of the Criminal Procedure Code (on public prosecutors), and under the Advocates Act 1961, senior counsels can plead on behalf of the advocate on record. There was thus, no legal bar on his appearance, he stated.
