During the hearing, the counsel for the petitioner submitted that under Section 202 of CRPC, there is no provision even for the magistrate to issue summons, and “in case how can the investigating agency issue summons the accused”.
The counsel in his submission countering the contention of petitioner Sohan Kumar that he fears arrest, said that under Section 202, even the investigating agency can inquire, but cannot carry out investigation. The matter has been adjourned to Tuesday.
