HC notice to State govt over caste certificate

The High Court on Thursday directed the State Government to issue caste certificate to an MBBS aspirant from Mangalore.

The petitioner Vijith Krishnan had moved the High Court after he was denied him a caste certificate of schedule caste citing reasons as a migrant from Tamil Nadu and as per the Supreme Court directions he is not entitled for it.

The petitioner, a son of an engineer at Kudremukh, who had secured 2540th rank in Common Entrance Test (CET) this year, was brought up in the State.

Having studied in Mangalore, the petitioner submitted that his mother is a native of Kasargod district and works in a bank.

 “I am not a migrant, but a descendent of a migrant and as per the Article 8 of Constitution of India and Article 19(1) (d), I cannot be rejected the caste certificate.”

Stating that the Supreme Court Judgment stating that the migrants are not entitled for caste certificate does not apply to him, the petitioner sought directions to issue caste certificate to him.

The division bench comprising Chief Justice Vikramajit Sen and Justice B V Nagarathna directed the State Government to issue him caste certificate within two months.
