Kanda now booked for evading summons in cheque bouce case

Police have registered a case against former Haryana minister Gopal Kanda and his brother Govind Kanda for evading court summons in a cheque bounce case.   

On court’s direction to police, the case against the brothers has been registered under section 174-A (punishment for non-appearance in response to court proclamation) with Connaught Place police station in New Delhi on Tuesday. 

They were booked in cheque bounce case which they settled recently.

Kanda and his brother Govind were declared proclaimed offenders in the case in May which they settled out of court last month.

The brothers had been facing summons and warrants issued by a Delhi court since 1998 in the cheque bounce case related to dishonour of Rs 4.10 lakh cheque issued by them.

The court said evading its summons and warrants was different from cheque bounce case and acquittal in one case does not absolve anyone of the second offence.

“The offence under section 174 A (proclaimed offender) of the Indian Penal Code and section 138 of the Negotiable Instruments Act (cheque bounce case) are two distinct offences and acquittal of the accused in the compoundable offence under section 138 of Negotiable Instruments Act act does not bar investigation into the offence under section 174 A IPC,” metropolitan magistrate Vikrant Vaid said.

The cheque bounce case was settled between the two parties on August 27 after Kanda brothers paid Rs 4.10 lakh to the complainant.

The 46-year-old MDLR Group owner Gopal Kanda is also an accused in the abetment to suicide case of Geetika Sharma as in her two-page suicide note, the victim had mentioned that Kanda was responsible for her death.

Geetika was found hanging from a ceiling fan in her house in Ashok Vihar on August 5.

The former flight attendant of the now defunct MDLR Airlines owned by Kanda, had accused him of harassing and forcing her to commit suicide.
