HC restricts overnight construction work

The High Court of Karnataka on Thursday asked the builders to stop construction activities in the City between 6 pm and 8 am every day.

Hearing a public interest litigation, which challenged the construction of an apartment along the Sarakki Main Road at JP Nagar I phase by the Sobha Developers Limited allegedly violating the National Building Code (NBC), the Division Bench comprising Chief Justice Vikramajit Sen and Justice B V Nagarathna passed the order.

Part of the petition filed by the JP Nagar I Phase Residents’ Welfare Association and its secretary B R Udupa, has also sought action against the Bangalore Development Authority (BDA), Bruhat Bangalore Mahanagara Palike (BBMP) and other civic agencies for permitting Sobha Developers to construct 231 apartments in a road nine metres wide, which was in  violation of the NBC.

During the hearing, the counsel representing Sobha Developers said, construction work was carried out till 10 pm and more than 50 per cent of the work has been completed.

Expressing shock over his statement, Justice Sen said: “You carry on the building work till 10 pm? Which law permits you to work till 10 pm,” he asked.

The court also observed that inconvenience was being caused to the residents as the construction work was carried on till midnight. “You (builders) just want to make money and have no concern for civilians. Do not harass people,” justice Sen said.

Counsel for the Sobha developers stated that the construction work was being carried out in shifts and work would be completed soon. The case has been adjourned to September 18.
