Compulsory retirement of dist judges upheld

The Division Bench of the Karnataka High Court on Thursday upheld the 2009 order of compulsory retirement of 13 district judges and set aside the single judge order for their reinstatement.

The Division Bench comprising, the Chief Justice Vikramajit Sen and Justice B V Nagarathna, heard the petition challenging the reinstatement of the 13 district judges and set aside the single bench order for their reinstatement.

It may be recalled here that the 13 district judges were given compulsory retirement following an order passed by the then Chief Justice of the Karnataka High Court Justice P D Dinakaran. The judges were found to be ‘unfit’ to discharge their duties for several reasons, including their low rate of disposal of cases, their conduct with the lawyers and some other complaints.

Challenging the order, the district judges approached the Karnataka High Court. On January 3 this year Justice Anand Byrareddy had set aside the order for their compulsory retirement
and directed their reinstatement.

Later, three more district judges approached the Karnataka High Court and got order for their reinstatement.
