<p>In the wake of Reese Witherspoon and husband Jim Toth's surprising arrest and brief jailing, the actress says she is sorry and "deeply embarrassed" for her behaviour.<br /><br /></p>.<p>The 37-year-old actress and her Hollywood agent husband were both arrested early Friday in Atlanta. Toth for an alleged drunk driving and Witherspoon for disobeying instruction from a police officer to remain in her vehicle during the traffic stop.<br /><br />The 'Legally Blonde' star has now released a statement of apology for her behaviour, reported E! online.<br /><br />"Out of respect for the ongoing legal situation, I cannot comment on everything that is being reported right now. But I do want to say, I clearly had one drink too many and I am deeply embarrassed about the things I said. It was definitely a scary situation and I was frightened for my husband, but that is no excuse," Witherspoon said.<br /><br />"I was disrespectful to the officer who was just doing his job. I have nothing but respect for the police and I'm very sorry for my behaviour," she added.<br /><br />A court hearing on the matter has been set in Atlanta Municipal Court but both Witherspoon and Toth are not expected to be present.<br /><br />Their lawyer probably will request the judge to postpone the court date, because Witherspoon is in New York City for the premiere of her new movie 'Mud'.</p>
