The members of the Arkavathi Layout Allottees’ Association have decided to move the court against the Bangalore Development Authority (BDA) if it did not revise the Arkavathi Layout plan by February 28.

The Association will go for contempt proceedings against the BDA in 75 cases, and 19 other allottees will go for second contempt proceedings against the civic agency and its commissioner if sites are not formed within the next 30 days.

Meeting inconclusive

The Association members pointed out that a meeting called by the town planning members of the BDA was inconclusive and they had, therefore, decided to move the court.

The Association will file cases of cheating and fraud against the BDA, as all objections and obligations on removal and deleting land was done before 2004 by the State government and by the BDA.

Also, registered and unregistered land were denotified without the consent of the allottees, which is a criminal offence.

The Association said all the 8,813 sites, before distributing allotment letters, were identified, marked, numbered and available under developed land.

The BDA cannot delete or denotify these land as it is a clear case of violation of Article 16G of the BDA Act.
