Nandakumar had challenged the Central Administrative Tribunal (CAT) order, annulling the promotion of KAS officers to IAS cadre.

The CAT under section 5 (3) of IAS officers (appointment and regulations) rules had annuled the appointment.

The petitioner had moved the High Court against the order as it applies to the officers who have been promoted since 2007. The division bench headed by Justice Dr K Bhaktavatsala, which heard the matter has directed not to disturb the appointment.
Merit and experience

The CAT, in its order dated November 30, had cited a Supreme Court order stating that IAS officers are promoted on the basis of merit and the experience should not be considered as a criterion, but despite this, fixing an age limit of 54 years for KAS officers to be promoted as IAS officers is illegal.
The CAT had quashed the rules. However, the petitioner had submitted that the rules are framed by the Union Government and the CAT cannot interfere here.
