<p>Nandakumar had challenged the Central Administrative Tribunal (CAT) order, annulling the promotion of KAS officers to IAS cadre. <br /><br />The CAT under section 5 (3) of IAS officers (appointment and regulations) rules had annuled the appointment.<br /><br />The petitioner had moved the High Court against the order as it applies to the officers who have been promoted since 2007. The division bench headed by Justice Dr K Bhaktavatsala, which heard the matter has directed not to disturb the appointment.<br />Merit and experience<br /><br />The CAT, in its order dated November 30, had cited a Supreme Court order stating that IAS officers are promoted on the basis of merit and the experience should not be considered as a criterion, but despite this, fixing an age limit of 54 years for KAS officers to be promoted as IAS officers is illegal. <br />The CAT had quashed the rules.
