The petitioner M C Ravikumar, a City-based advocate, has challenged the Salary Allowance and Pension of Member of Parliament Act 1954 and Karnataka Legislature of Salary and Pension Allocation Act 1956, under which the elected representatives are entitled for salary and pension.
Citing that the payment of salary and pension is unconstitutional, the petitioner said that it was only salary and allowance for MLAs and MPs when the Constitution was framed. He submitted that the elected representatives are not employees of the State and their service is not a service as contemplated under the Service Law.
