SC rectifies mistakes, sets three accused free

A four-judge bench of Chief Justice K G Balakrishnan, Justices S H Kapadia, Altamas Kabir and R V Raveendran said that all the persons —Bhoja, Puran, Balbir and Raghubir — are to be set free. “We are setting these people at liberty as no appeal stand against them.’’
Raghubir, who has been on bail since February 20, 2009, was also acquitted.

Chaudhury, appearing for co-accused, in a murder and rioting case pointed out the mistake of a three-judge bench headed by Justice Arijit Pasayat, who convicted his clients when there was no appeal against them.

Rectifying its first mistake, the bench recalled the judgement pronounced by the bench headed by Justice Pasayat on November 7, 2009, in which they had been convicted without even hearing them.

The second lapse was when the other four  accused — Sughar Singh, Laxman, Onkar, Ramesh — were released on bail after admitting in March 2010 their curative petition, but these persons (co-accused) were not granted bail as they were not before them. The third lapse was when on Tuesday, a three-Judge bench headed by the CJI refused to grant an early hearing despite knowing that the persons were in illegal confinement at Datia jail in MP.
