KAT quashes MUDA commissioner's transfer order

Mangaluru Urban Development Authority (MUDA) Commissioner K Srikanth Rao, who was transferred on December 29, 2017, through an order by the Department of Personal and Administration Reforms (DPAR), has been directed to assume the same post, following an order by the Karnataka State Administrative Tribunal (KAT) on Thursday.

Soon after the transfer, Rao had approached the KAT questioning his premature transfer, following which the KAT, headed by Justice K Bhakthavatsala, quashed the order issued by the DPAR on December 29, 2017. The KAT also directed him to assume duty immediately.

The KAT order stated that the newly posted officer should immediately hand over the charge to Rao, failing which the applicant is permitted to assume the charge of the post of MUDA Commissioner.

It may be recalled here that the government had posted Prashanth Kumar, a KAS officer, as MUDA Commissioner and had transferred Rao without assigning any post. Incidentally, Prashanth Kumar is the husband of DCP Uma Prashanth. Subsequently, the DPAR issued on order posting Rao as the General Manager of Mangaluru Electricity Supply Company Ltd (MESCOM) on January 20.

However, Rao approached the KAT citing that his transfer was in violation of the government transfer guidelines, which says Class I officials should not be transferred within two years of posting. He was posted as MUDA Commissioner on September 13, 2016.

Prior to his posting as MUDA Commissioner, he served as the deputy resident commissioner, Karnataka Bhavana, Delhi. Incidentally, he was transferred to Delhi following the demolition of an illegal building in Udupi, while he was serving as the Commissioner of Udupi City Municipal Council in 2013.

Prior to his transfer to Udupi, he served as the joint commissioner of Mangaluru City Corporation.
