BBMP, govt get notices on illegal construction

The high court issued a notice to the BBMP and state government on Friday with regard to illegally constructed shops and buildings on the service road adjoining the Madiwala-Sarjapur Road.

A division bench of Acting Chief Justice H G Ramesh and Justice P S Dinesh Kumar was hearing a public interest litigation filed by Reggie Thomas and three others, seeking directions to the Palike to demolish the constructions and restore the service road for public use.

According to the petitioners, the BBMP was constructing illegal shops to accommodate street vendors.

The Madiwala-Sarjapur Road, also known as the Madiwala Market Road, is approximately 100 feet, connecting Hosur Road and Sarjapur Main Road. Presently, 40 feet is encroached upon by way of the footpath, median and service road, the petitioners said.

The service road, which is around 30-ft wide, is a public amenity and has to facilitate vehicular and pedestrian movement, they said.

The matter was posted to Monday.
