CBI to file appeal in 2G case soon

The CBI is planning to file an appeal in Delhi High Court against the acquittal of the accused, including DMK leaders A Raja and Kanimozhi, in the 2G spectrum case within a week.

Sources said the challenge in the high court against the special court's judgement on December 21 last year could come as early as Friday and the CBI's 2G investigation team has already held discussions with Additional Solicitor General Tushar Mehta, who was appointed Special Public Prosecutor last week.

The legal team and CBI investigators are finetuning the appeal to be filed in the high court. The CBI investigation team met Mehta on Monday, too.

The CBI had on December 21 last year announced that it will challenge the special court order, saying the judge had not appreciated its evidence in full.

The agency will tell the high court that the evidence that they placed before the special court has weight and it should be seen in proper perspective.

The appointment of Mehta, who is considered close to Prime Minister Narendra Modi and BJP chief Amit Shah, comes as the special court judgement castigated the prosecution led by Anand Grover, who was appointed by the Supreme Court.

Mehta, who will be the third special public prosecutor, is learnt to have been convinced that the CBI has a case to present in the high court in the case.

Grover was appointed special public prosecutor after U U Lalit was appointed a Supreme Court judge.

The government notification about Mehta's appointment did not mention about the status of Grover in the case.

Mehta's appointment was criticised by senior lawyer Prashant Bhushan, who tweeted: "Government brazenly changes SPL (special) public prosecutor of 2G case appointed by Supreme Court and appoints Modi/Shah's main lawyer Tushar Mehta as prosecutor in gross violation of Supreme Court's order. Govt getting more brazen by the day."
